This Promotional giveaway (“Ultimate Franschhoek Winter Experience ”) is organized by Franschhoek Wine Valley (the “Promoter”)
The Promotion is open to anyone over the age of 18 (eighteen) years, except any minor and any employee, director, member, partner, agent or consultant or any person directly or indirectly who controls or is controlled by the Promoter and/or immediate family members of any employee, director, member, partner, agent or consultant of or person indirectly or directly in control or controlled by the Promoter, who may not participate in this Promotion.
By entering the Promotion, all Participants and the winners agree to be bound by these rules which will be interpreted by the Promoter, whose decision regarding any dispute will be final and binding. The Promoter reserves the right to amend, modify, change, postpone, suspend or cancel this Promotion and any giveaways or any aspect thereof, without notice at any time, for any reason which the Promoter reasonably deem necessary.
The promotion runs from 19 June 2019 until 26 June 2019 (“Promotion Period”).
The grand prize includes: Two tickets for Bastille Day 2019, a helicopter transfer from Cape Town to Franschhoek (one way trip), a Jaguar F-Pace to utilize during the Bastille Day weekend, dinner and wine pairing for two at Foliage Franschhoek, a couples spa experience at Mont Rochelle, two tickets for the Franschhoek Wine Tram and two nights accommodation at La Chataigne. Only the meals/transfers, accommodation and other prizes mentioned in the competition will be provided, any other expenses incurred to the winner will be at their own expense. This includes but is not limited to: travel, food, drinks, and items of a personal nature.
All persons who follow the competition “call to actions” on the @Franschhoek_SA Instagram account will be considered for the Giveaway.
The prize is only valid for the weekend of 13th and 14th July 2019 herein referred to as “Bastille Weekend”. Should the winner be unable to claim the prize on this weekend they will forfeit the prize and another winner will be chosen. Should the winner not claim their prize no consolation prize will be awarded or offered.
Winners must present proof of identity in order to redeem their Giveaway.
The Giveaway is neither transferable nor redeemable for cash. The Promoter reserves the right to substitute the Giveaway with any other give-away item of comparable commercial value. Should one of the prize sponsors cancel their prize the promoter is not obligated to replace this prize or compensate for this prize.
No liability shall attach to the Promoter in relation to any claims, losses or liabilities for any loss of profit or any other direct and/or indirect, special or consequential loss arising out of any of the Giveaways.
Should any dispute arise in relation to the interpretation of these promotional rules the Promoter’s decision shall be final and no correspondence shall be entered into.
All Participants and the winners, as the case may be, indemnify the Promoter, their advertising agencies, advisers, nominated agents, suppliers and its affiliates and/or associated companies against any and all claims of any nature whatsoever arising out of and/or from their participation in any way howsoever in this Promotion (including, as a result of any act or omission, whether as a result of negligence, misrepresentation, misconduct or otherwise on the part of the Promoter and/or use of the Giveaways).
The Promoter may require the winners to complete and submit an information disclosure agreement and indemnification to enable the Promoter to ensure compliance with these Rules and the Consumer Protection Act 68 of 2008. Should any winner refuse or be unable to comply with this rule for any reason, such a winner will be deemed to have rejected the Giveaway and it shall revert back to the Promoter.
The Promoter may require the winners to be identified, photographed and published in printed media, or to appear on radio and television, when accepting their prizes or after having received their prizes. The Promoter may use the uploaded images in whole or in part, and any reproductions thereof, worldwide for advertising, promotion, publicity or otherwise on any website for any media purpose and for any other lawful purpose whatsoever.
By entering the Giveaway, the participants agree that Franschhoek Wine Valley and its affiliates may contact the participants via email and through social media platforms to deliver marketing communications regarding their products and promotional activities, provided that the Participants are given the opportunity to opt-out of receiving marketing communication at any time via the appropriate opt-out mechanisms provided by the Promoter for such purpose.
